Welcome to MicroPayWork! These Terms of Service ("Terms") govern your use of our website and services ("Service"), managed by MicroPayWork. By using our Service, you agree to these Terms, including our Privacy Policy, Refund Policy, and Cookie Policy.

ACCOUNT REGISTRATION

Eligibility: You must be at least 18 years old to use our Service. By agreeing to these Terms, you represent and warrant that you are of legal age.

Account Security: You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You accept responsibility for all activities that occur under your account.

Accuracy of Information: You agree to provide accurate, current, and complete information about yourself as prompted by our registration forms. You agree to update such information to keep it accurate, current, and complete.

Single Account Policy: Each user may maintain only one active account. Duplicate or multiple accounts may be suspended or permanently banned without notice.

USE OF THE SERVICE

Permitted Uses: You may use the Service only for lawful purposes and in accordance with these Terms. You may post micro jobs, offer gig services, apply for tasks, and transact through the Platform as intended.

Prohibited Uses: The following activities are strictly prohibited:

- Engaging in activity that is fraudulent, harmful, or that infringes on others' intellectual property rights.

- Posting misleading, deceptive, or false job descriptions or gig service listings.

- Submitting plagiarized, stolen, or fraudulent work.

- Attempting to circumvent the Platform's payment system or conducting transactions outside of MicroPayWork.

- Using bots, automated tools, or scripts to access or interact with the Service.

- Harassing, threatening, or abusing other users.

- Uploading malicious software, viruses, or harmful code.

User Content: You are responsible for the content you create, upload, or display while using the Service. We reserve the right to remove any content that violates these Terms or that could be considered offensive, illegal, or harmful. You retain ownership of your content but grant MicroPayWork a non-exclusive, worldwide license to display and distribute it in connection with the Service.

PLATFORM ROLE

MicroPayWork operates as an online marketplace that connects clients (job posters and gig buyers) with freelancers (job workers and gig sellers). MicroPayWork is not a party to any agreement between clients and freelancers. We act solely as an intermediary platform and do not guarantee the quality, safety, legality, or accuracy of any job posting, gig service, user profile, or user-generated content. Users are independently responsible for complying with all applicable laws and regulations in their respective jurisdictions.

PAYMENTS AND TRANSACTIONS

Wallet System: All transactions on MicroPayWork are processed through an internal wallet system. Users must deposit funds into their wallet before posting jobs or purchasing gig services.

Fees: You are responsible for all charges incurred under your account, including any applicable service fees or commissions charged by MicroPayWork. Fee structures are displayed on the Platform and may be updated from time to time.

Payment Processing: Deposits and withdrawals are processed through third-party payment providers, including Stripe. By using these payment methods, you also agree to the respective payment provider's terms of service.

Refunds: Refunds are processed according to our Refund Policy, which is incorporated into these Terms by reference.

Transaction Security: We take reasonable measures to protect the security of your transactions, but we cannot guarantee total protection against all breaches. You agree to report any unauthorized transactions immediately.

INTELLECTUAL PROPERTY RIGHTS

Ownership: All intellectual property rights related to the Service and its original content, features, functionality, branding, and design are owned by MicroPayWork or our licensors. This includes but is not limited to the MicroPayWork name, logo, website design, and proprietary software.

License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business use in accordance with these Terms. This license does not include the right to copy, modify, distribute, sell, or lease any part of the Service.

TERMINATION

Account Termination: We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms or engage in any activity that we determine, at our sole discretion, to be harmful to the Platform, other users, or third parties.

Effect of Termination: Upon termination, your right to use the Service will cease immediately, and you must cease all use of the Service. Any funds remaining in your wallet at the time of termination will be handled in accordance with our policies. MicroPayWork reserves the right to withhold funds if fraudulent or prohibited activity is detected.

DISCLAIMERS AND LIMITATIONS OF LIABILITY

Service "As Is": Our Service is provided "as is" and "as available" without any warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability: In no event will MicroPayWork, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

Indemnification: You agree to defend, indemnify, and hold harmless MicroPayWork and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service or your violation of these Terms.

DISPUTE RESOLUTION

Governing Law: These Terms are governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law principles.

Dispute Resolution: Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it will be submitted to final and binding arbitration under the laws of Sri Lanka, except as otherwise stated in these Terms.

CHANGES TO THESE TERMS

Modifications: We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the "Effective Date" at the top. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
